Terms of Service

1. Agreement to Terms

By accessing or using Konstaro ("the Service"), operated by Konstaro ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Konstaro is a software-as-a-service (SaaS) performance management tool designed for HVAC, plumbing, and electrical service businesses. The Service enables users to enter weekly technician performance data and automatically generates scorecards, morning meeting agendas, bonus and commission sheets, and business health dashboards.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@konstaro.com if you become aware of any unauthorized use of your account.

4. Subscription and Payment

• The Service is offered at $149.99 per month, billed monthly through Stripe.
• New accounts receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.
• Subscriptions auto-renew each month on your billing date. You may cancel your subscription at any time through your account settings or by contacting us.
• If you are subscribed through a coaching partner, revenue split arrangements between Konstaro and the coaching partner do not affect your subscription price.

5. Refund Policy

We do not offer refunds for partial months of service. If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period. To avoid being charged for the next billing cycle, cancel your subscription before your renewal date.

6. Acceptable Use

When using Konstaro, you agree not to:

• Resell, sublicense, or redistribute the Service or access to the Service to any third party without our written consent.
• Use automated tools, bots, or scripts to scrape, crawl, or extract data from the Service.
• Use the Service for any illegal activity or in violation of any applicable local, state, national, or international law.
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems and infrastructure.
• Upload or transmit malicious code, viruses, or any other harmful technology.
• Interfere with or disrupt the integrity or performance of the Service.

7. Data Ownership

You retain full ownership of all business data you enter into Konstaro, including technician names, performance metrics, and financial figures. We do not claim any ownership rights over your data. You grant us a limited license to use your data solely for the purpose of providing and improving the Service.

8. Service Availability

We aim to maintain 99.9% uptime for the Service, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to scheduled maintenance, system updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime when possible.

9. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service.
• Engage in fraudulent or illegal activity.
• Fail to pay your subscription fees.
• Use the Service in a manner that could harm other users or our infrastructure.

If we terminate your account for a violation, we will provide notice and, where reasonable, an opportunity to export your data. You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.

10. Limitation of Liability

To the maximum extent permitted by law, Konstaro and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to these terms or the Service shall not exceed the total amount you paid to Konstaro in the twelve (12) months preceding the event giving rise to the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless Konstaro and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or your violation of these Terms of Service.

12. Changes to These Terms

We may modify these Terms of Service from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised terms constitutes your acceptance of the changes.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be resolved in accordance with applicable federal and state law.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
